Why Seek an Expungement?

By having your record expunged, you will have more freedom in many aspects of your life. With your record expunged, you may legally tell people that the arrest or conviction never happened. Only certain government officials will have access to your original record – the charges or conviction will not show up in background checks and the like.

Expunging an Arrest Record

If you were arrested but never convicted of a crime, you will have an easier time requesting and obtaining an expungement.

You may request an expungement if:

  • It has been at least 30 days since the arrest
  • Charges were never filed
  • Charges were filed but the case was dismissed
  • Charges were filed but you were acquitted
  • You have no pending criminal cases

Expunging a Conviction

Under certain circumstances, you may be able to have a conviction sealed from your record. There are very strict requirements regarding which convictions can and cannot be expunged. For example, sex offenses and capital and first-degree felonies can never be expunged.

It is also required that you have paid all related fines and fees associated with the conviction in question. Depending on the type of crime you were convicted of, you will have to wait anywhere from three to 10 years to request an expungement for your conviction.
